Training Terms and Conditions
1. The Training vessel Motor Yacht ‘Crystal Rapide’ is operated by Second Wind Sailing & Motor Cruising Limited [hereafter called ‘Second Wind’] Second Wind is an RYA recognised training centre.
2. The training agreement is made between Second Wind and the individual booking the training [the student]
3. The training course fee set by Second Wind includes tuition by a qualified skipper, fuel, and use of wet weather gear [excluding boots.] It also includes such accommodation and meal arrangements as set out in the confirmation letter at the time of booking.
4. All bookings must be accompanied by a booking form and non refundable deposit for 50% of training course costs. In the event of the booking being made within 4 weeks of the training date the full cost will be due.
5. In the case of unavoidable cancellation of the training course by Second Wind an alternative training course date may be offered. If this is not acceptable all monies will be returned and the liability of Second Wind will cease. In the case of cancellation by the student, cancellation more than 4 weeks prior to the course date, only the deposit will be retained by Second Wind. If the booking is cancelled within 4 weeks of the training course date the full cost will be retained.
6. In the case of adverse weather conditions or predicted adverse weather conditions it may be necessary to vary the course start or end point. In this case transport will be arranged, if required, to the original embarkation point. In some circumstances it may be necessary to cancel a course or exam at short notice if either the instructor or examiner feels that this is justified for safety reasons or because of unacceptable operational conditions.
7. The student will be responsible for any mooring fees or harbour dues which may become payable whilst the vessel is away from its home port or other designated starting point.
8. The owner of the vessel and Second Wind Motor Cruising will not be liable for any loss, damage, death or personal injury to any guest. Second Wind Motor Cruising have a £3,000,000 Third party and passenger liability insurance which affords protection, on standard marine terms to any student in control of the training vessel under the direct supervision of our skipper. Second Wind Motor Cruising accepts no responsibility other than the provision of said insurance for any claim that may be brought to bear. RYA Instructors do not accept responsibility for any loss, damage or injury suffered by persons and/or their property arising out of or during the course of their activities whilst training or instructing unless such injury loss or damage was caused by, or resulted from, negligence or deliberate act.
9. Second Wind operates a No Smoking policy aboard Crystal Rapide’.
10. Although it may not affect the clients ability to take part in the training activities, it is important that details of any medical conditions or treatment being taken are made known to Second Wind prior to the training dates.
11. Decisions made by the Instructor are final in respect of the safety of the vessel and well - being of the students. This may entail change of route, or in extreme cases curtailment of the training activity. The instructor will remain the sole judge of all matters concerning seamanship and safety of the vessel. If any students fails to comply with the reasonable requests of the skipper, the skipper may return the vessel to the place of embarkation whereupon the student will be disembarked and the student will not be entitled to any part of the training fee or any other recompense.
